Conditions of sale
1. Scope of Application

Deliveries and other services performed by yellowatch shall be carried out solely on the basis of the following General Terms and Conditions. The General Terms and Conditions may be amended at any time by yellowatch. Any deviations and amendments shall be valid only if expressly acknowledged by yellowatch and if claimed in writing. Within the meaning of these General Terms and Conditions: - "we" and "us" stands for yellowatch; - "you" and "customer" stays for the purchaser: - "both parties" stands for yellowatch and the purchaser.

2. Products

a) yellowatch only offers authentic brand watches. b) Unless mentioned otherwise in the description of the individual product, all watches are delivered in their original packaging, including the official manufacturer's warranty certificate. c) yellowatch operates independent from any watch brand listed on this website

3. Prices

a) All prices listed on the website or individually confirmed by e-mail do not include costs for delivery, duties and other administrative fees or banking charges. b) The prices are quoted in US Dollar, Euro, Swiss Francs (CHF) at the current rate. c) The customer may choose his preferred currency for payment. d) yellowatch reserves the right to modify prices listed on the website or communicated by e-mail at any time and without prior notice. e) Prices, technical changes, errors and misprints reserved. f) Upon confirmation of the customer's order, prices shall be deemed to be confirmed and not subject to any change.

4. Taxes and Customs Duties

a) The prices quoted in Swiss Francs (CHF) include VAT of 7.6%. b) For the prices quoted in Euro and US Dollar, VAT and any other taxes, duties and local administrative fees are excluded. Any applicable taxes and duties must be paid by the customer to the agent upon receipt of the ordered goods. c) For further information, please e-mail us at info@yellowatch.com.

5. Order

a) An order is binding for both parties if placed by: - filling out the electronic order form under "buy now" - phone at +41 79 363 33 53 - fax at +41 81 750 68 11 - online by e-mail at info@yellowatch.com b) Delivery shall take place after full purchase price has been paid. Please check method of payment for more details. c) The purchased watch remains the property of yellowatch until the full purchase price has been settled. d) yellowatch reserves the right to refuse an order without giving any reason.

6. Payment

a) The customer is required to pay the full purchase amount to yellowatch before an order is shipped. b) Payment options: the customer may choose one of the following payment methods: Pay Pal, Visa, MasterCard, American Express, invoice (prepayment) and cheque (upon request). The order will be shipped immediately after the payment has been confirmed. c) If paid by credit card, the cardholder's billing name and address has to be the same as the shipping address. d) If paid by cheque, yellowatch will reserve your watches while your cheque clears. The cheques may be issued to: yellowatch.com Alpenstrasse 13 CH - 6300 Zug / Switzerland e) yellowatch reserves the right to refuse a credit card without giving any reason.

7. Shipping

a) All orders shall be provided for delivery according to the symbol of item description. Shipments to the United States, Canada and other countries shall be made by Fedex. Our international customers will receive invoice for taxes and duties from assigned carrier. b) The customer will be informed by e-mail of the tracking number as soon as the goods have been dispatched. c) The watches shall be delivered to the address as stated in the order. The customer has to make sure that his watch has been delivered in impeccable condition. Claims must be submitted immediately to the carrier or within 3 days upon receipt of the goods to yellowatch. The customer shall bear the risk of transportation of postal items sent back to yellowatch. d) All shipments are fully insured by yellowatch. e) Aggregated orders are possible and safe postage! 8. Terms of Delivery

a) All watches shall be shipped to the customer according to their item description immediately upon receipt of payment. b) Shipping to the United States, Canada and other countries shall be made by Fedex and will take approximately 2-3 days. c) Shipping within Switzerland and to Europe shall be made by Swiss Post Priority Service. The delivery time within Switzerland will approximately take 1-2 days, to Europe 4-6 days. Fedex offers worldwide delivery to more than 200 countries in 2-3 days (source: http://www.fedex.com. yellowatch does not make any binding guarantees regarding shipping times, which may vary depending on the destination. d) In case of delay or other delivery problems, yellowatch will notify you by email stating the expected delivery time. e) The customer may check the status of the order at info@yellowatch.com at any time. f) Should yellowatch for any reason be unable to supply a watch for which an order has been accepted, the agreed purchase price will be refunded. Any other additional expenses regarding refund shall not be reimbursed.

9. Transfer of Title and Risk

a) Title and risk shall pass to the customer upon shipment of the order. In case of aggregated orders, title and risk shall pass to the customer upon dispatch of the complete order.

10. Warranty / Repair

a) All new watches are delivered with an international manufacturer warranty. The warranty period depends on the brand and model. Normally, the watches come with a 12 to 60 month international warranty. The exact period is determined in the official warranty certificate. b) If your watch needs repair, please contact us at info@yellowatch.com. yellowatch will engineer the repair of your valuable watch. Please always present your manufacturers warranty card. This procedure is exempt of charges for our valued customers within warranty period. Watches may also be taken to a manufacturer’s approved dealer for any necessary repair. c) Normal abrasion and defects caused by any negligence, incorrect treatment or inadequate maintenance are explicitly excluded from warranty. Battery, sapphire- and mineral crystals as well as watch bands are not covered by any manufacturers guarantee. Please see details on original warranty card. d) Like any high-precision instrument, watches need to be serviced regularly in order to work perfectly. Please contact us at info@yellowatch.com if you wish to receive our offer. yellowatch offers professional watch repair by our authorized watch ateliers in the US and in Switzerland. Even though manufacturers warranty has expired, we will be delighted to take over professional care and maintenance of your valuable timepiece.

11. Liability

a) The warranty shall be exercised according to the applicable legal provisions and Terms and Conditions of yellowatch. yellowatch shall only be liable for defects which appear and are properly notified in writing within the warranty period, providing the defect was not caused by negligence, improper handling or insufficient maintenance. b) The business policy of yellowatch is simple and customer-friendly: yellowatch solely accepts returns in case description of the item is not conform to the delivered watch. yellowatch endeavours to describe all offers in detail with its best professional skills. However, sometimes it may happen that details may be overlooked and not mentioned in the description, even though we take every effort to accomplish best possible accuracy. Such little discrepancy does not entitle the customer to return the ordered watch. A fair solution shall be mutually agreed between both parties. c) yellowatch excludes any liability for damages caused by the assigned carrier during transportation.

12. Return Policy

a) All products have been controlled before shipment in accordance with yellowatch's strict quality inspection. Should the product for any reason not satisfy your demand, the product may be returned to or replaced by yellowatch within 7 days after receiving the product. b) Before returning the product, the customer has to demand a RMA authorization number at info@yellowatch.com. Without such number, no return shall be accepted. c) The product has to be returned unused, impeccable and in its unopened original packing together with all original documents. Except the costs for the return delivery, no other expenses have to be carried by the customer. d) The product has to be duly packed and returned to yellowatch by registered mail. A copy of the invoice together with the reasons for the return have to be added in order to settle the request as soon as possible. The return delivery has to be sent to:

13. Security / Data Protection

a) yellowatch will process and store customer's personal data with strict confidence according to the provisions of the Swiss Data Protection Act (Schweizerisches Datenschutzgesetz). b) yellowatch only requests personal data required to fulfil the agreement with the customer. c) Personal Data including your email-address is only transferred to third parties if explicitly agreed to by the customer, whereby the acceptance may be cancelled at any time. Hereof excepted are the service companies that need your data to process the order (i.E. carrier charged with shipment of your order and credit institution to handle your payment) d) yellowatch reserves the right to inform you about interesting news and developments or important changes of the website. e) The customer is entitled to get free information about its personal data and to have its personal data adjusted, blocked or deleted at any time. For further information, please contact info@yellowatch.com. f) yellowatch provides the latest technical and organizational protection to safeguard the customer's privacy against random and wilful manipulation, damage, loss and against the access of unauthorized persons.

14. Applicable Law

a) These General Terms and Conditions are subject to the laws of Switzerland. b) Any dispute arising out of or in connection with these General Terms and Conditions shall fall within the jurisdiction of the courts at the place of the registered office of yellowatch.
